项目摘要

今年度は、国会の立法過程への直接民主制的制度導入の可否の検討をスイス、イタリア、フランスと日本の比較研究を中心に実施した。日本国憲法は、間接民主制を採用し、法律が国会の議決のみで成立するのに対し、憲法改正のためには国民投票が必要であり、日本においても、2007年に憲法改正のための国民投票を実施する手続き法が成立した。同法の成立に際しては、国政上の重要問題に関する一般的国民投票制度の検討が委員会において附帯決議され、政治的な課題として位置づけられるようになった。今年度は、日本における諮問型の一般的国民投票制度の導入の可否について、拘束的な国民投票制度を採用している先進各国の制度や運用の比較を通じて考察を実施した。憲法で国民投票を制度化しているスイス、イタリアでは、憲法改正に関するイニシアティブや法律制定後の拒否的国民投票または廃止的国民投票について、国民からの発議を制度化し、立法に対する国民からの提案や事後的な統制を可能としている。これに対して、日本では、憲法４１条や５９条の規定から、拘束的な国民投票制度は不可能なものの、諮問型の一般的国民投票の導入は可能である。先進各国の事例との比較から、一般的国民投票について国民からの発議を可能とすることや、一般的国民投票に加えて廃止的国民投票を現行法に対する国会の立法判断の材料とするなどの活用、国民からの提案に対する国会における十分な検討と精査などの仕組みを取り入れること等が、諮問型の国民投票の制度化やその運用において必要かつ有効であることを示した。
