本研究は、正規・非正規労働者間の待遇格差に関する不合理性判断における考慮要素の捉え方や具体的な違法性判断について、比較法の知見を活かして検討を行い、日本における正規・非正規労働者間の公平な労働条件とはなにを指すかを模索している。本研究では、早い段階から（男女間の）同一労働同一賃金原則、間接差別原則、非正規労働者に対する不利益取扱い禁止原則という３つの法規制によってこの問題に取り組み、かつ非正規労働者に女性が多いという点で日本と共通点を有するイギリスを参考にしている。イギリスでは、1970年代から伝統的な男女差別・人種等差別禁止の観点からの「（男女間の）同一労働同一賃金原則」・「間接差別原則」を法文化し、現在は両原則とも2010年平等法に規定されている。平等法は伝統的な差別を禁止するものであり、パートタイム労働あるいは有期雇用といった雇用形態に基づく不利益取扱いを同法の規制対象に含めていない。しかし、同一労働同一賃金原則・間接差別原則における条文構造や客観的合理的理由に基づく格差の違法性判断を分析することで、法原則の根源は異なるものの、条文構造に類似点があることから、日本の正規・非正規間格差への示唆を検討する。他方、イギリスにおける雇用形態に基づく不利益取扱い禁止規則に関する制定経緯や改正状況を考察する。不利益取扱い禁止規則に基づく裁判例は決して多くないが、裁判例の蓄積が少ない理由についても検討しながら、これらの裁判例を分析する。日本の正規・非正規雇用労働者の待遇格差に関する裁判例がいくつも出され、積極的に待遇改善をすすめていくか否かという点で、学説の対立が依然続いている。これらの論点を分析することで、正規・非正規労働者間の公平な労働条件に関するこれまでの議論の到達点を整理し、日本の規制手法の課題を検討するとともに、イギリスの多様な規制手法から示唆を得る。
