本研究課題は、刑事立法の活性化状況の中でのあるべき刑事立法分析枠組の構築という目標の下、立法者を直接拘束することができ、かつ、憲法訴訟の場において適用可能な立法分析枠組の構築を目指すものである。令和4年度においては、令和2年度から継続する刑法上の基本原則とされる責任主義の憲法上の地位に関する研究の中間まとめ、および、方法論としての刑事憲法学に関する研究を中心に実施した。責任主義の憲法上の地位については、ドイツの判例調査の結果として、①責任主義の保障内容はいかなるものであるか（責任主義命題の特定の問題）、②その保障内容は、憲法のいかなる規定を根拠として導出されるものであるか（法的根拠の同定の問題）、③〈責任主義〉は憲法上の原理なのか、憲法上のルールなのか（責任主義の憲法上の性質の問題）、④非難可能性のない行為の処罰禁止を憲法上の責任主義に組み込む場合、憲法が体系上、非難の伝達を内容とする刑罰概念を前提としているのか（憲法上の刑罰概念の問題）が論じられるべきことを明らかにした。この観点から、日本の判例の整理作業を行い、判例における責任主義の位置づけについて一定の見通しを得た。方法論としての刑事憲法学については、①ドイツにて、このアプローチで研究している複数の研究者へのインタビュー調査を実施した。②ドイツにおける基本論文（Gaerditz, JZ 2016, 641-650）の全訳を行い、公表した。③フランクフルト大学（ドイツ）のChristoph Burchard教授に依頼し、ドイツにおける刑事憲法学の議論状況についての知見提供のため、日本での講演会を実施した（その成果は、令和5年度中に投稿、公表の予定である）。これにより、議論状況を相当程度把握できた。その他、日本の刑事立法学に関する近時の研究動向をレビューする作業を行い、国際シンポジウムにおいて報告した。
