本研究は、わが国で多発する大規模自然災害の被災者が円滑に生活再建を行うためにいかなる支援が必要かという視点から、特にいわゆる「二重ローン問題」に着目して、その解決策を探るものである。住宅ローンなどを負担している個人が被災した場合、被災したことにより既往債務の弁済が困難となり、債務超過に陥る可能性が高い。しかし、この場合の個人債務者は、通常の破産時とは異なり、債務超過となったことに対する帰責性がない、又は帰責性があっても非常に低い状態にある。この点については一般に理解されている一方で、被災という事情を踏まえた、被災者債務者と債権者の間の問題を解決する基準が従来はなかったところ、2016年4月に「自然災害による被災者の債務整理に関するガイドライン」が発効され、特定調停を利用して、被災債務者の信用情報を毀損しない形で債務整理を行う途が開かれた。しかし、その後の本ガイドラインの利用状況をみるに、本ガイドラインの利用者が特定の被災地に集中していることから、本ガイドラインの存在が被災者に対する実質的な支援につながっているか、疑問がある。そこで、本研究は、本ガイドラインの利用状況を調査し、その妥当性ないし有用性について検討したうえで、被災者の生活再建のための新たな法制度構築の是非について検討することを目的としている。計画3年目の2022年度前半は、期間中に調査した本ガイドラインの利用状況について、各災害の内容および被災状況を踏まえて分析し、各災害におけるガイドラインの必要性および利用実態に関する検証を進めた。そして、2022年7月にその内容について学会報告を行い、同11月には論文を公表した。

This study aims to investigate the utilization of natural resources, their appropriateness, usefulness, reconstruction of the lives of the victims, and the construction of new legal systems. In the first half and middle of the year 2022 of the plan, we will investigate and analyze the utilization status of natural resources, the content of each disaster and the disaster situation, and the necessity and utilization status of each disaster. In July 2022, the content of the report was published, and in November, the paper was published.
