项目摘要

著名商標の一種である地域団体商標に関する研究成果を期間中に論文として公表した。地域団体商標から一般的商標に出願を変更するという実例を分析することで、著名性の異同を検討することができた。また、７００年続く商標に対して地理的表示保護が認められなかった例についても論文を公表した。著名性の保護とその利用について、複数当事者が関与する場合の調整について、商標法のような先願主義を採用しない制度における対処の問題が明確になった。これにより、著名商標の保護が、制度によっては、必ずしも十分に機能していないこと、このための対応策を明らかにした。特徴のある土地と企業家の連携によるブランディングの例を調査することで、企業家の著名性を連携する土地につなげるブランディング手法を分析することができた。これにより、商標を含む名称そのものの著名性と、すでに周知になっているイメージ等との連携によるブランディングについて分析することができた。新型コロナにより困難となっていた海外調査について、米国の調査を行うことができた。ニューヨークで経営されているラーメン店のブランド調査を行い、これにより、たとえば、ラーメンのような事業における商標そのものの著名性とラーメンという商品名の果たすブランド効果についての分析にとりかかることが可能となった。ラーメンの場合は、すでにそれ自体に特定のイメージが付加されているため、これを利用した顧客ターゲティングとブランディングを行い、その上で、自社名称ないし商標による特徴付けが効果的であることがわかった。
