特許権の機能的クレームと記載要件について、及び、米国における特許権の消尽について、さらに、特許法における先使用権について研究した。いずれも特許法のテーマであって、本研究課題の商標法ではないが、本研究課題である商標法における公序良俗違反の不登録事由は、上位概念化すると、知的財産権による独占と、独占権の及ばないパブリックドメインとの棲み分けをどのように設定するかという問題であり、本年度に研究した特許法のテーマも、その意味では同じ課題を扱うものであった。特許権の機能的クレームと記載要件のテーマは、クレームが機能的文言により書かれている場合に発明の公開による公益への貢献が十分かを問題にする論点であり、これについては、2022年10月29日に開催された早稲田大学知的財産法制研究所及びペンシルバニア大学ロースクール主催「第11回グローバル特許権行使戦略セミナー」第1部「米国特許法と日本特許法における記載要件と実施可能要件」において、「医薬発明の機能的クレームと記載要件―日本の場合」と題して講演した。米国における特許権の消尽のテーマは、特許権と特許製品の自由流通のバランスを問うものであり、これについては、パテント76巻1号 23-36頁(2023年1月)に、「米国における特許権の消尽」と題する論文を公表した。このテーマは、日米比較をした点において、本研究課題と共通するテーマである。特許法における先使用権は、特許権と、同一発明を先に実施していた者との公平を図る先使用権のバランスを問うものであり、これについては、日本弁理士会中央知的財産研究所研究員として、2023年2月24日の研究部会で発表したほか、2023年3月3日に開催された同研究所第20回公開フォーラムにおいて、「先使用権の緩やかな認定？―特許権の緩慢な死？」と題して講演及びパネルディスカッションを行った。
