项目摘要

本研究は生活保護の不正受給における「不正」とは何か,「不正受給」とは何か、福祉事務所による不正受給の認定の実態はどのようになっているのか、それはどうあるべきか、不正受給の防止策はいかにあるべきかを検討し、不正受給に対する適正な生活保護行政を構築することを目的としている。令和２年度は福祉事務所における生活保護不正受給の判断のあり方などの検討を行い、被保護者の状況を把握しているといわれるケースワーカーが「不正受給」と判断した理由、根拠などとともに、保護費の返還にあたっての裁判例を検討した。令和3年度は福祉事務所設置自治体であるK自治体（K市）と共同研究の協定を結び、K市での在宅の被保護世帯全てを対象にアンケート調査を行った。ここでは、アンケート内容、方法等について検討したうえで実施し、その一部ではあるがアンケートの結果概要をまとめることができた。また、生活保護返還金についての行政の判断について裁判例の検討を行った。令和4年度は、被保護者の就労支援の視点から生活保護行政の不正受給の扱いについて検討するとともに、福祉事務所における不正受給の判断方法の実態を研究し、その成果の一部について学会報告（貧困研究会「福祉事務所による生活保護不正受給決定の判断方法―ケース診断会議録からの検討―」）をおこなった。また、生活保護不正受給に関わる裁判例の検討も行った。
