プラットフォーム産業における、一定以上の顧客ベースを持つ市場支配的事業者に対する競争法上の懸念の根底には、「巨大であること」それ自体に対する懸念もみられる。デジタルプラットフォーム産業における競争者排除型行為の規制のあり方という広い意味での本研究の対象を論じるうえでは、政治的なイデオロギーやいわゆるポピュリズムと呼ばれる価値観が独禁法ないし競争法の規制とどのように関わっているのかを明らかにしておく必要がある。そこで、まず、本年度は、競争者排除型行為規制の目的と各種イデオロギー、そして各種経済厚生基準の関わりを整理、分析した。具体的には規制目的を経済的目的と政治的・社会的目的とに分類したうえで、それらと、ポピュリズムやネオブランダイス、中道進歩派といった各種の価値観や立場が相互にどのような関係にあるのかを整理した（研究①）。また、前年度の成果を引き継ぎ、独禁法2条5項における「排除」概念の解釈について、デジタルプラットフォーム関連の規制との関わりでどのようなことが言えるのかを、「独占の梃子」類似の排除の規制を視野に入れて検討した（研究②）。上記研究①及び②は拙著『私的独占における排除概念の再構成』（商事法務、2022年）に収録されている。なお、初年度の研究成果をもとに、不当廉売規制についてデジタルプラットフォーム事業者による廉売への規制介入を視野に入れた検討を行った論文を英語で執筆し、2022年6月に国際学会で報告を行う予定である（査読、アクセプト済み）。以上の研究成果を踏まえて、本年度の後半は、デジタルプラットフォーム事業者による市場のある側面での力の他の側面での転用という問題を論じるのであれば、近年しばしば問題として取り上げられているプラットフォームの自己優遇措置に焦点をあてて検討を進めるべきだという仮説を得、研究を進めてきた。この成果は2022年度中に公表予定である。
