前年度の成果をもとに、独占禁止法2条5項における「排除」概念に関する検討を行い、博士論文としてその成果を纏め、所属機関に提出した。具体的には、不当廉売と単独の取引拒絶に焦点をあて、平均可変費用以上・平均総費用未満の廉売や、単独事業者による直接かつ一方的な取引拒絶が独禁法上不当となりうるのはどのような場合か、そして、その根拠は何かを探究することで、日本の最高裁が示した排除概念の定義の解釈論を展開した。当初予定していた「すべての行為類型に普遍の排除の識別基準の探究」という研究の射程を変更し、検討対象を不当廉売と単独の取引拒絶とした。しかし、対象を絞って検討を行ったことで、かえって、単独の取引拒絶の分類のあり方や、総費用を上回る廉売の不当性に関する議論のような、日本では見過ごされてきた論点を見出し論じることができた。このように、当初予定していなかった成果を得られたため、今年度の研究進捗については期待以上であったと考えている。なお、不当廉売に関する議論について詳細な検討を行ったものを2018年度中に法学論叢に投稿済みであり、当該論文は2019年度中の掲載が決定している。
