项目摘要

本研究課題は、武力紛争法の適用において、近年の暴力の発生状況を踏まえた、武力紛争法適用範囲の体系的整理を行うことを目的とする。本研究の分析枠組みは、基礎的研究と発展的研究に分かれており、基礎的研究として武力紛争法の適用基準となる事実主義の妥当範囲と、発展的研究として事実主義の限界を特定する。今年度は、昨年度から着手している発展的研究のうち、行為者自身の主観的認識に焦点をあてた。国際刑事裁判所（ICC）における戦争犯罪構成要件のうち犯罪の状況に関する要件として、客観的要素である武力紛争と行為の関連要件（関連要件）と、主観的要素として、状況認識要件（認識要件）がある。関連要件と認識要件に関する従来的理解として、充分な関連がある場合当然行為者が認識している、すなわち関連要件が成立する場合には認識要件が当然成立するという前提があった。このような従来的理解のもつ問題が近年の武力紛争と行為との関連が比較的希薄な戦争犯罪の事例を通じて浮上した。従来の形式的証明がもたらす問題として、武力紛争と行為の関連が希薄である場合には、行為者の認識は明白ではなく疑う余地が残るという問題が生じた。この点につき、国際法研究会にて、「国際刑事裁判所における戦争犯罪の武力紛争状況認識要件」と題した報告を行った。また、フィリピンにおける「麻薬戦争」を人道に対する犯罪として捜査するなど、ICCの管轄犯罪概念を拡張しようとする傾向について、国際刑事判例研究会において検察官の捜査開始許可請求の紹介を行った。また2020年度の報告を元にした「国際刑事裁判所における戦争犯罪の組織性・大規模性要件の位置づけ―重大性審査における発現」が『国際法研究』に掲載された。2020年度に出産・育児のため研究中断を行い、本科研の実施期間は2022年度まで延長されたが、2022年3月に特別研究員を採用辞退しそれに伴い研究課題も終了する。
