项目摘要

2018年度は、主に武力紛争法の適用における事実主義の妥当範囲について検討を行った。まず、武力紛争は国際的と非国際的なものに区分され、後者については戦争違法化以前の戦時国際法の規律の対象外であったため、戦争の違法化に伴う事実主義的適用への転換がどの程度妥当しているのか明らかにする必要があった。この点につき、国際刑事法からの示唆として、戦争犯罪の構成要件のひとつである関連要件の解釈に関する議論を参照した、論説を発表した。（松山沙織「戦争犯罪における武力紛争と行為の間の関連要件の意義―非国際的武力紛争を中心に―」『阪大法学』第68巻3号（2018年9月））さらに、大阪大学大学院国際公共政策研究科招へい研究員越智萌氏との共著で、ミャンマーにおける民族紛争を題材とした、非国際的武力紛争における法的規律に関する論説を執筆し英文論文集に掲載される。（Megumi Ochi and Saori Matsuyama, “Ethnic Conflicts in Myanmar: The Application of Law on Non-International Armed Conflict,” in Suzannah Linton, Tim McCormack & Sandesh Sivakumaran (eds), Asia Pacific Perspectives on International Humanitarian Law (Cambridge UP,forthcoming））また、非国際的武力紛争における武力紛争法適用における当事者の主観的認識の影響に関して中台紛争を題材として扱い、台北および金門島を訪れ、台湾軍関係者および法曹関係者から情報を得た。また人道に対する犯罪と戦争犯罪につき調査するため、ドイツにてケルン大学関係者との協議およびナチス資料センターにて資料を得た。
