最終年度にあたる2020年度は、国家の権利義務形成に影響を及ぼす国際法内容とその形成過程が主権平等原則に基づくという国際法理論を打ち立て、これを立証するため国際実行の分析を行い、関連の先行研究を整理した。研究では、主権平等原則と法形成過程を統制する規定群の関係について次のような理論的考察を加えた。すなわち、国際法が国際社会の組織化に伴い当初、国家による自由意思に基づく自己実現を可能とする形で発展したことを分析した。つまり、武力行使の禁止、強制による条約の無効、条約法条約における「自由意思による同意」は、国際社会が共有する課題との関係で自国の役割を画定する際に国家が自己実現を可能とする国際法の展開であることを考察した。しかし、国際法の分権的構造のため、条約締結における強制の有無や条約の趣旨との両立性の有無の判断者が問題であり、国家の意思の恣意性を抑制することに限界があること、国家意思の恣意性を抑制する要素が別途確保されなければならないことを論証した。また国際実行の分析を通して気候変動枠組条約・国際民間航空機関・国際海事機関の温暖化対策策定過程に関する市民社会の参加とその影響力、透明性・文書アクセスの確保に向けた取り組み、そして条約体制間の相互作用という国家同意以外の国家の権利義務形成に影響を与える諸要素、それらの由来である国際法の展開も各国家の適切な役割を画定するために存在することを明らかとした。さらにこれらが有機的一体性をもって国家の権利義務を形成する際に重要性を帯びてきたことを明らかにした。また以上の研究成果を2019年度の研究成果と併せまとめることで博士論文を完成させ、成果公表のため学会報告と論文投稿に取り組んだ。
