本研究は、既存の研究において分断されてきた教会組織と都市民の関連を考察の基盤として、都市内における社会集団形成の諸相の解明を目的とするものである。採用初年度にあたる本年度はまず始めに都市内における教会組織の相互連関およびその内部における聖職者のキャリア形成について研究に着手し、翌年度以降の課題に対して教会を包含した都市社会状況の枠組みを提供することを企図した。都市内の宗教機関における制度的発達を調査し、さらにその就任者の足跡を辿りリンクさせることで各教会組織が担った役割および特色の整理が達成された。また第2の課題として13世紀に世俗裁判と呼応する形で進展した教会裁判権とその実践についての研究に着手した。都市法等の規範史料に加えて裁判の結果もたらされた証書史料の分析からは、トリーアにおいては1220 年代以降、世俗の参審員により法的行為の証書発給が行われるようになり、教会の領域では司教裁判官が登場し都市民の中には彼らの方へ案件を持ち込む者もいたことが明らかとなっている。これまでの研究の過程で後者の重要性を認識するに至ったため、役人による司法的活動を教会権威と都市社会の結節点として捉え、統治行為やコミュニケーションを通じた教会の在り方とその運用の実態に着目した。召喚・審理・判決・執行といった裁判手続の詳細な再構成を目的とするのではなく、いかなる法廷に案件が持ち込まれたのかという都市民による教会裁判の利用実態に着目することで、教会司法官吏の位置づけや都市民による司法権威の認識について考察を加えることが次年度へ続く課題として持ち越されている。

This study aims to analyze the relationship between church organizations and urban citizens, and to clarify the formation of social groups in urban areas. In the first year of the year, the interrelationship between church organizations in the city and the formation of clergy in the city began, and in the next year, the organization of church organizations in the city included the development of social conditions. The development of the system of religious organizations in the city was investigated, and the footprints of the incumbents of the church organizations were investigated. The second issue is the development of the secular judgment and the practice of the church judgment in the 13th century. Urban law and other normative historical data, including the analysis of the results of the judgment, the certificate of the historical data, the certificate of the behavior of the secular and secular judges since the 1220s, and the certificate of the behavior of the judicial judges since the 1220s.
