项目摘要

本研究の目的は、忌避施設立地問題の合意形成促進手法を決め方の公正さの観点から明らかにすることである。忌避施設立地問題とは、公益のためには必要だが一部に負担が偏るために合意形成が困難となる問題である。その合意形成には、利害当事者の議論による論点整理と、市民による多元的な公益的観点からの評価が必要だが、利害が明らかになると地域住民が決定後に反発することもある。そこで、候補地が絞られる前の誰もが立地地域住民となる状態、すなわち無知のヴェール下で決め方に事前合意することの有効性を検証する。2021年度は、前年度までに行った仮想シナリオ実験のデータを再分析し、国際学術誌に投稿した。この論文では、忌避施設を立地する政策段階、決め方の方針段階、立地地域となった段階という三段階の受容を従属変数とし、決め方の方針で提示される決め方が無知のヴェールを適用したものか否かを操作しその効果を検証した。また、昨年度に行った高レベル放射性廃棄物処分地選定合意形成ゲームについて論文を執筆し、シミュレーション＆ゲーミングに掲載された。これまでの5つの査読付論文を整理し、博士論文としてまとめた。学位申請論文は、受益－受苦関係が固定化する以前の誰もが当事者となり得る状況で、負担をどう分け合うかについても議論の俎上に載せ、多主体が多段階に関与する合意形成プロセスのあり方を示した。個別具体的な場面における決定手続きの公正さの主観的評価のみならず、政策・方針・立地段階の受容といった多段階において多主体が関与し議論するという決定枠組みとしての手続き的公正を捉え直し、その意義と課題を取りまとめた。また、利害関係不明という意味の無知のヴェールを、関わる全ての人ではなく市民パネルに被せることの実践的な位置づけも明確化した。無知のヴェールという規範概念を現実にあり得る形として実証的に検討し、具体的な様相として提案した。
