项目摘要

令和３年度は昨年度に引き続き、権力分立論と議院内閣制の関係において、行政計画とは区別される政治的計画を憲法学の課題として取り上げた上で、議院内閣制の下において頻繁に見られる「計画を策定する政府」と「計画を法律や予算で実現する議会」という現実政治の状況を権力分立原理との関係でいかに位置付けるか、という点に注力して研究を行った。具体的には、ドイツ国法学を参照した上で、憲法秩序における計画と権力分立の関係を明らかにしつつ、議会と政府の間における計画作用の配分のあり方について論じた。以上の研究成果については、「計画と権力分立」と題する博士論文として、京都大学大学院法学研究科に提出した。本研究は、憲法上その概念がないにもかかわらず現実政治の上では大きな影響力を持っている「計画」と権力分立原理の関係を明らかにした点、政府と議会に対する計画権限の配分のあり方を検討した点、通常であれば行政の権限に属する事柄を議会が法律で決定した「法律による計画」をめぐる権力分立上の問題を通じて「行政の留保」について検討を加えた点、我が国の各種基本法に規定されている基本計画について分析を行った点などにおいて、意義を有するものと思われる。本研究は、その中心的課題である計画と権力分立の関係について、抽象的な次元においては議会も政府も執政／国家指導として計画作用を「共有」しつつ、具体的な次元においては両者が憲法に基づく各々に固有の責任・作用・方法において計画活動を行うことができると結論付けた。この点、本研究は、現実政治上の課題としての「議会による政府計画の統制」については、計画の議会留保といった解釈論を導出するものではなかったため、さらなる検討が必要となる。
