本研究の課題は、宋代以降、死刑に次ぐ重刑がつねに軍制との関係を有しながら推移した事実に焦点をあわせ、近世中国の法秩序とその特徴を明らかにすることにある。その第四年目にあたる令和四年度は、第一に、宋代の刑罰体系のなかでも特異な位置を占める配軍刑の構造と特質を明らかにするための基礎作業として、これまでに引き続き、『慶元条法事類』刑獄門と当贖門の会読作業を進めるとともに、関連史料の整理と分析を行った。会読作業では新たに巻75は徳永が、また巻76は徳永と中村が訳稿を作成し、毎回の担当者が関連史料との校合と分析を加えたうえで、参加者全員で精査・検討するかたちをとった。当該の作業にあたっては、前年度と同様にオンライン形式を採用したことから、史料の校合作業をさらに精密に行うことができた。第二に、明代の充軍刑に関する分析作業では、これまでに収集した関連史料をもとに分析を進めるとともに、宋代の配軍刑と共通する特徴と相違を掘り下げて検討することに精力を傾注した。この結果、明代の充軍刑では軍戸に対する強制移住という側面を基本としながらも、民戸を軍戸に編成替えすること自体が犯罪者処罰と観念されていたことを明らかにした。そのうえで、宋代の配軍刑では必須とされた刺字（いれずみ）が明代の充軍刑ではなぜ姿を消したのか、その歴史的背景を改めて検討した。第三に、宋代以降の刑罰制度と密接に関連する官僚制の問題について、「宋代官僚制の形成―元豊官制の歴史的意義」を執筆し、『岩波講座世界歴史』第7巻「東アジアの展開 八～一四世紀」（岩波書店、2022年4月刊行）に掲載・刊行した。

The subject of this study is the relationship between military system and death penalty since Song Dynasty. The focus is on the characteristics of legal order in modern China.
