本研究の目的は台湾司法院大法官会議が行使している憲法の解釈および法律・法令の統一解釈権の運用実態を解明し、日本・中国との比較を通じて、法秩序の形成ないし台湾政治の民主化に伴う法の支配と人権保障の確立・深化におけるその役割を明らかにすることである。2022年度は引き続き新型コロナウイルス感染症による影響で、台湾への調査訪問が実現しなかったが、文献調査とオンライン調査の併用により、2022年からの憲法法廷（憲法裁判所）の運用実態を確認することができた。約1年の間に下された計24件の判決（従来の大法官解釈相当）の内、違憲または一部違憲の判決は計11件で、既存の大法官解釈を変更した1件の判決、及び法律の解釈を統一するための判決3件も計算に入れると、既存のルールに対する修正が全15件にも及び、全体の6割を超えている。判決は多岐の分野に及んでいるものの、特に刑事手続法上の被疑者・被告人の権利保障、男女平等、原住民の権利保障といった人権擁護に関わる事件において、多くの違憲判決が出されており、憲法法廷が人権擁護に一層積極的に寄与しようとする姿勢がうかがえる。人権擁護に対する憲法法廷の姿勢は台湾の民進党政権の姿勢と同調する側面もあるのではないかと考えられる。蔡英文政権は民主主義と自由を重視する価値観外交を展開しており、中国からの圧力に対抗するために、普遍的価値（人権擁護も含めて）へのコミットメントをアピールしている。憲法法廷がその影響を受けている可能性は否定できない。実際のところ、食肉や食肉製品の輸入基準について、現政権寄りと考えられる合憲判決も出されており、台湾の司法と政治との近い関係を示唆している。また、同性間に婚姻を認めない民法を違憲とした大法官解釈が同性婚に関する特別法の制定に繋がったほか、外国人との同性婚を認める内政部通達の制定にも寄与しており、大法官解釈の強い影響力を示した。

The purpose of this study is to clarify the interpretation of the Constitution and the unified interpretation of laws and decrees in the exercise of justice in Taiwan, to compare Japan with China, to clarify the formation of legal order, to establish and deepen the democratization of Taiwan's politics, to establish and deepen the rule of law, and to clarify the separation of services. In 2022, the impact of the introduction of new types of HIV infection, the implementation of research visits in Taiwan, the use of literature research, and the confirmation of the application of the Constitutional Court (Constitutional Tribunal) in 2022 In the past year, there have been 24 judgments (including the judgment of the Supreme Court), 11 unconstitutional judgments, 1 judgment of the existing Supreme Court, 1 judgment of the existing Supreme Court, and 3 judgments of the unified legal interpretation. The judgment is divided into different areas and special areas, and the suspect in the criminal law, the defendant's benefit protection, gender equality, indigenous people's benefit protection, and the support of the people.
