2022年度は、2021年度に引き続いて、イギリスの信教の自由に関する重要判決の一つであるWilliamson事件諸判決及びそれらに関する諸文献を読み込み、イギリスにおける信教の自由考察の出発点構築を目標とした。第一に、Williamson貴族院判決における各個別意見を要約するとともに、同事件における貴族院の立場を解明するために、各個別意見間の共通点と相違点を一部析出することができた。第二に、同事件における控訴院の立場を明らかにするべく、同控訴院判決における各個別意見の共通点及び相違点を一部析出することができた。また、同控訴院判決の抱える諸問題を特定するために、同控訴院判決の評釈を読み込み要約することができた。第三に、非典型的宗教的実践の自由に対する規制の合憲性を判断する複数のアプローチを抽出するべく、本件における控訴院、貴族院及び控訴院評釈の立場を部分的に比較検討することができた。第四に、上記の第一点を反映させた論文（「信仰表明の自由規制の合憲性判断構造に関する覚書〔二〕」）を公表することができた。同論文においては、同貴族院判決が、非典型的宗教的実践の自由に対する規制を端的に信仰表明の自由に対する規制として捉えるものであるとともに、信条の真正性が問題となるとき裁判所はそれを客観的基準に照らして吟味できないとする点において控訴院判決と同様であるけれども、ストラスブール先例にいうCampbell基準を信仰表明が問題となる時点において適用するのみならず、制約該当性ではストラスブール先例を厳格に適用するものではない点において控訴院判決と異なることを明らかにした。

In 2022 and 2021, important decisions related to freedom of religion were made, decisions related to Williamson events and documents related to freedom of religion were published, and the purpose of freedom of religion investigation was established. First, Williamson House of Lords judgment offers, colleagues, the position of the House of Lords, the common point between the individual opinions, and the point of disagreement. Second, if the position of the Complaints Court is made clear regarding the case, the commonalities and contradictions between the individual opinions in the judgment of the Complaints Court can be clarified. The Court's decision on the matter is a matter of opinion. Third, the practice of atypical religion is free to judge the constitutionality of the regulations. This case is a comparative study of the positions of the Court of Appeal, the House of Lords and the Court of Appeal. Fourth, the first point of the above note is reflected in the paper ("The Constitution of Freedom of Belief Expression"). The same article, the same noble house judgment, the atypical religious practice freedom to regulate the end, the belief to express the freedom to regulate the end, the creed authenticity to question, the judgment to express the guest's standard, the judgment to express the end, the judgment to express the end. Campbell's benchmark belief is that the problem is applicable at all times, and that the nature of the problem is governed by precedents.
