2022年度は、引き続き、本研究課題の主たる分析対象である信教の自由と同性愛者の権利・人工妊娠中絶の権利の対立に関連するアメリカ合衆国における判例の動向について、一次資料および二次資料に基づく分析・検討を行った。その成果の一つとして、2018年のMasterpiece Cakeshop判決に関する論稿を執筆した。当該論稿については、2023年度中に公刊される予定である。その上で、本研究の取りまとめ作業として、これまでの研究成果を踏まえつつ、アメリカにおける信教の自由に関する近年の動向について、保守派による信教の自由の「武器化」という視点から整理・検討するとともに、かかる動向の中で宗教に対する法適用免除をめぐるリベラル派と保守派の対立構図がいかに「変容」しているかについての分析・検討結果をまとめる作業に着手した。その成果については2023年度中に研究論文の形にまとめ、所属機関の紀要（神戸学院法学）において公表することを予定している。さらに、上記動向とも密接に関連する動向として、第１修正の「武器化」と呼ばれる近年のアメリカにおける動向について言論の自由の領域を中心に分析・検討を行う論文（「第1修正の武器化をめぐってーアメリカ合衆国における「言論の自由」法理の現代的課題」水島朝穂先生古稀記念『自由と平和の構想力』所収）を執筆し、所属研究会（アメリカ憲法研究会）において信教の自由に関する最新の合衆国最高裁判所判決（Kenedy v. Bremerton School District (2022)）について報告を行った。

In 2022, the main analysis object of this research topic was the freedom of religion and the benefits of co-sex. The relationship between the benefits of artificial pregnancy and the United States was analyzed. The primary data and the secondary data were analyzed. A review of the results of the 2018 Masterpiece Cakeshop judgment was written. When the manuscript is published, the public publication in 2023 will be scheduled. The research results of this study are based on the recent trends of religious freedom, including the weaponization of religious freedom, the conservative viewpoint, the reorganization of religious freedom, and the discussion of religious freedom. The law of religion is applicable to the movement, and the law of conservatism is applicable to the organization. The analysis of the results of the examination is carried out. The results of the 2023 academic year will be published in the form of research papers, and the report of the affiliated institution (Kyoto College of Law) will be published in the form of public statements.
