本研究は、国際的な民事紛争解決手続における在外証拠の収集・取調べに関して、２１世紀になって急速に展開してきた現代的課題、すなわち、①電子証拠およびインターネット等の電子通信手段を通じた証拠の域外的収集、②知的財産権侵害における国際証拠保全、③国際商事仲裁の場における域外的証拠収集等について、条約や実務の現状の把握とその理論的分析を、国際私法学、国際民事手続法学、国際知的財産法学および国際法学の視点から総合的に研究することを目的とする。最終年度は２０２１（令和３）年度の予定であったが、新型コロナウィルス感染症蔓延防止策による研究活動の縮小があったために、本年度への研究期間延期が認められた。なお継続中であった蔓延防止策の中で、本年度は、最終的な文献の収集、読み込み及び整理を中心に積極的に行った。なお、昨年公表予定であった「Introducing Information Technology to the Japanese Code of Civil Procedure and Cross-Border Service of Process and Examination of Evidence」は２０２３（令和５）年の公表予定となった。来年度への再延長が認められたことから、以上により得られた有益な知見に基づき、研究の成果を鋭意、論説としてまとめる。なお、中央当局である外務省領事局政策課に関しては、２０２３（令和５）年５月に対面で調査訪問を予定している。
