项目摘要

本研究は，代償請求権規定とその要件たる履行不能規定とをセットで有する唯一の外国としてのドイツを比較対象国と定め，代償請求権につき，権利論的分析に加える一方，その発生原因としての行為論的分析も合わせて進行させている。研究初年度（2019年度）には，私法学会個別報告「代償請求権と履行不能」を実施し，2年目（2020年度）には，権利論的分析として，論文「ドイツ相続法における代償財産」を公表した。3年目（2021年度）には，北海道大学（民事法研究会・民法理論研究会共催）シンポジウム「ドイツ売買論の現在」を開催して頂き口頭報告および刊行（北大法学論集）をさせて頂く一方，私法学会第個別報告「ドイツ売買論の現在――判例・学説・立法の三位一体――」を実施し，さらに，「代償財産」に関する研究を発展させ，「ドイツ民法におけるデジタル遺産――フェイスブック事件――」（磯村保古稀）を公表した。これらを受けて，当該年度，すなわち4年目（2022年度）には，次の3点において研究計画を具体的に実現することができた。第1に，権利論的分析として，上記「ドイツ民法におけるデジタル遺産」の補論，「デジタル遺産に関するドイツ・フェイスブック事件再論」沖野眞已ほか編『これからの民法・消費者法（Ⅰ）』河上古稀（信山社）787頁～804頁を公表した。第2に，行為論的分析として，相続法の「遺言の自由」に関し，最新の立法判例に関する，「ドイツ民法における『遺言の自由』――判例と世話組織法(BtOG)――」原田剛・田中宏治ほか編『民法の展開と構成』小賀野古稀（成文堂）229頁～244頁を公表した。第3に，2022年8月にドイツに滞在し，共同研究者のディーター・ライポルト教授とともにドイツ相続法体系書の翻訳作業を進め，『ドイツ相続法（仮題）』として本研究最終年度（2023年度）中に刊行する目処を立てた。
