项目摘要

2022年度は、民事信託に関与する専門家、とりわけ弁護士などの法律専門家が、民事信託の設定時および存続中において果たすべき役割や留意すべき点について、信託の当事者支援という観点から研究を行った。信託を利用すれば、成年後見や遺言と比べて、多様、柔軟かつ確実な財産管理や財産承継が可能になる反面、委託者本人の制度上の保護は手薄である。特に信託法は、私的自治の範囲を広く認めており、多様な内容決定を可能にしているが、高齢の委託者が子などの親族受託者に誘導され、委託者の真意でない信託が設定されてしまうおそれがある。また一般的な監督制度も存在しないため濫用に弱い。したがって、民事信託の設定においては、弁護士などの法律専門家が、①委託者の意思能力があること、②信託設定意思があること、③信託行為の定めが公序良俗・強行規定に反しないことを確認しなければならず、また、④監督体制構築を助言し、⑤信託口座開設に向けて協力することが望ましい。さらに、信託存続中において法律専門家は、⑥受託者の円滑な信託事務処理を支援し、⑦委託者または受益者が、信託の変更権または終了権を行使する際には、その意思決定を支援することが求められるというべきである。また、民事信託の担い手として専門職受託者を拡充するために、信託業法を改正することも検討する余地がある。以上の点を述べた研究成果を、「年金と経済」42巻1号（2023年）に公表した。

In the case of a trust, the trustee shall have the right to support the trustee in handling trust affairs, and the trustee shall have the right to support the trustee in making rational decisions during the execution of the trust. There is room for improvement in trust law. The above mentioned research results are listed in "Annual Report" No. 42 (2023).
