自由権規約27条が定める文化享有権は、多種多様なマイノリティ集団の存在を背景に、享有主体の差異に応じて権利の内実が異なる多層性を特徴としている。そして、国際社会全体において、また各地域において変動するマジョリティとマイノリティとの関係に位置付けて、文化享有権自体の発展可能性が把握されなければならない。こうしたことを念頭に置いて、当該年度は、文化享有権の歴史的発展を、①権利の由来、②権利概念の伸長、③権利救済の展開の三点から分析することとした。具体的には、①については、ヨーロッパ人権条約の歴史的過程における少数者の権利の集団性の承認や自由主義的人権間の普遍性を問い、②については、ユネスコを中心として発展してきた文化多様性保障の動向と文化享有権の関係性を問い、③については、自由権規約27条に関する国内外の先例の蓄積を念頭に置きながら、歴史的な植民地化の不正義に対する是正（redress）が文化享有権にどの程度託されているのかを問う。こうした視点にたって、3回の本科研メンバーでの研究会を実施した。その研究成果を、京都大学での国際法研究会（２０２２年７月）で報告し、国際法学会の公募分科会 C「国際法上の文化享有権の歴史的定位─二風谷ダム訴訟判決から四半世紀」（座長：中央大学教授小坂田裕子）と題したパネル報告（同年９月）で、下記のように公開することができた。1 ヨーロッパ人権条約における文化多様性の保障　京都先端科学大学教授 西片 聡哉2 文化享有権の現在と未来　敬和学園大学准教授 藤本 晃嗣3 二風谷ダム訴訟に見る文化享有権の多層性　関西学院大学教授 齋藤 民徒4 コメント　弘前大学助教 山下 梓

Article 27 of the Constitution of Freedom: Cultural enjoyment, diversity, diversity The international community as a whole, the geographical position of the relationship, the cultural enjoyment of the possibility of development This paper analyzes the development of cultural enjoyment history in the current year, the origin of profit, the extension of profit concept and the development of profit rescue. The concrete problems include: (1) the process of drafting human rights treaties, the collective recognition of minority interests and the universality of liberalism among human beings,(2) the development of cultural diversity, the protection of cultural diversity and the relationship between cultural enjoyment,(3) the accumulation of precedents at home and abroad, and the accumulation of ideas related to Article 27 of the Freedom Treaty. The injustice of planting and localization in history is a positive (stress), a cultural enjoyment, a degree of trust, and a question. This is the third time that the scientific research team has been working on this issue.
