信託とは受託者（一般に信託銀行や信託会社などの機関受託者）が設定者（委託者）から財産を受託し、受益者のために管理する制度です。この研究課題の主眼は信託をプリンシパル＝エージェント関係（当人と代理人の関係）として捉え、その仕組みと役割を経済学的に分析することにあります。この課題は基礎的な研究（2か年）と応用的な研究（3か年）の二段階で構想され、2022年度は応用的な研究の第二年度に当たっていました。本年度はこれまでの主要な成果の一つである信託における意思決定の把握を前提として、管理上の意思決定の主体が異なる信託財産の蓄積を二部門モデルによって定式化するとともに、受益権の内容を規定する実績配当主義に重点を置いて信託財産の蓄積に対する信託法の効果の一端を明らかにすることができました。実績配当主義は実務的でありながら信託の本質を捉えた原則であり、信託財産から発生する損益の受益者への完全な配分を規定しています。本年度の研究により、信託財産の利益率を前提とするとき、信託財産の蓄積が簡単な微分方程式によってモデル化され、このモデルによって受益者への運用利益の配分とその効果が解明されました。その際に受益者に帰属する運用利益を受託期間に亘って最大にする配分割合が信託財産の利益率と受託期間の長短によって決定されることが示されています。さらに信託における運用利益の配分方針はその目的（例えば受益者への利益配分、信託を用いた財産形成など）によって当然異なり、これは信託行為によって定められ、かつ受益者の利益専一という忠実義務のもとで受託者によって実行されます。ゆえに実績配当主義のもとにおける運用利益の配分に着目した本年度の考察により、信託財産の蓄積を軸として、信託の法的・制度的な仕組みと意思決定の帰属を含めた受託関係とを一体的に関連づけ、これらを統合して分析する端緒が得られたと考えられます。

This project is based on basic research (2 years) and applied research (3 years). The second stage of research is expected to be completed in 2022. This year, the main achievements of the trust law are: the premise of rational decision-making, the main body of rational decision-making in management, the accumulation of trust property, the focus of trust property accumulation, and the focus of trust property accumulation. The principle of performance allocation is to determine the nature of the trust and to provide for the full allocation of profits and losses to the beneficiaries of the trust property This year's research focuses on the premise of trust property profit ratio and the effect of trust property accumulation on the distribution of benefits among beneficiaries by simplified differential equations. The maximum amount of interest allocated to the beneficiary during the trust period, the percentage of interest of the trust property, and the length of the trust period are determined. The distribution policy for the use of benefits in a trust is intended for different purposes (e.g. distribution of benefits to beneficiaries, formation of property in the use of the trust). This year's survey focuses on the distribution of benefits, the accumulation of trust property, the organization of trust laws, the integration of trust relationships, and the analysis of trust relationships.
