2022年度は，いじめ重大事態に関わる裁判例の分析，いじめ重大事態調査「第三者委員会」の委員経験者に対する聴き取り調査とその分析を進めた。裁判例では，大阪地方裁判所判決令和４年11月11日に象徴されるように，第三者委員会ないしはその委員長の責任を追及する訴訟が登場しはじめた点に特質を見出すことが出来る。訴え自体は退けられたものの，この種の訴訟の登場は，いじめ重大事態「第三者委員会」の設置，そしてその委員への就任に対して確実に萎縮効果をもたらす。それ故，いじめ防止対策推進法の主柱の一つである，いじめ重大事態「第三者委員会」による調査制度そのものを機能不全に陥らせる可能性が存在している。いじめ重大事態「第三者委員会」の委員経験者への聴き取り調査からは，「被害者児童生徒・保護者に寄り添う」という基本理念の解釈に関する葛藤が明らかになった。「学校の設置者及び学校は，いじめを受けた児童生徒やその保護者（以下「被害児童生徒・保護者」という。）のいじめの事実関係を明らかにしたい，何があったのかを知りたいという切実な思いを理解し，対応に当たること」とされている（文部科学省「いじめの重大事態の調査に関するガイドライン」）。この姿勢は，学校の設置者及び学校の下に置かれる，いじめ重大事態「第三者委員会」にも共有されるべきものである。しかし，被害者側から次々と出される要望を全て受け入れ，調査に当たるとしたならば，時間，労力等の負担が大きなものとならざるを得ない。「被害者児童生徒・保護者に寄り添う」こととこの現実的問題との調整に苦慮した委員経験者が少なくなかった点は，いじめ重大事態調査「第三者委員会」の定着を考える上で解決すべき課題の一つと考えられる。
