今日、学校教育の危機が声高に叫ばれ、21世紀へ向けて新たな学校像の模索が行われている。公教育は、そもそも現行の社会制度・システムを次の世代へと伝達していくことを主要な目的の一つとしているはずである。そして、その中心に憲法の理念が据えられてしかるべきはずである。この点、教育基本法は、その前文において自由で民主的な社会の実現は「根本において教育の力を待つべきもの」と宣言し明確にこの点を意識している。教育改革の過程において学校教育の意義と目的が再検討が進みつつある。第15期中央教育審議会は、「21世紀を展望した我が国の教育の在り方について」と題する答申には、「子供に[生きる力]と[ゆとり]を」という副題が付けられている。「生きる力」とは、「いかに社会が変化しようと、自分で課題を見つけ、自ら学び、自ら考え、主体的に判断し、行動し、よりよく問題を解決する資質や能力」であり、「自らを律しつつ、他人とともに協調し、他人を思いやる心や感動する心など、豊かな人間性」であるとされる。この説明は、西洋近代が前提とする「自律的個人」の定義とオーバーラップする。しかし、この事実は、50年以上も前、教育基本法が高々と謳い上げた公教育の目標が、未だに実現していないことを認めることに他ならないのである。調査の結果、不登校の権利、教育内容のスリム化、学校と家庭、地域社会との連携、いじめ問題等議論は多義にわたる議論が、あまりにも細分化し、公教育全体を貫くマクロ的視点、すなわち憲法保障機能としての公教育という意識が欠落しているという結論が導き出された。公教育の場に「近代」を定着させるべき手法を今後の研究課題としたい。

For more than 50 years, the Basic Law of Education has been in existence for the purpose of public education. The results of the investigation, the benefits of non-enrollment, the diversification of educational content, the connection between school and family, the regional society, and the problems of middle school have been discussed in various ways, such as segmentation, the perspective of public education as a whole, the constitutional protection function, and the lack of awareness of public education. The field of public education is "modern" and the research topic in the future is determined.
