项目摘要

本研究は、グアテマラのアパレル産業とメキシコの自動車産業を事例として、グローバル・バリューチェーン（GVC）における途上国の経済発展を労働人権の視角から分析し、「社会基盤の強化に基づくGVCの持続的発展」の分析枠組みを提示することを目的としている。2021年度までの研究から、アパレル産業と自動車産業のいずれのセクターにおいても多国籍企業は労働基準を含むCSR活動の自社内部化が一般化していること、およびアクター間の対立はアパレルではGVCの内部の企業と外部の監視組織の間で、自動車産業ではGVCの内部アクターである事業所内の経営と労組の間でそれぞれ見られることを確認している。2011年に「国連ビジネスと人権に関する指導原則」が発表され、国連加盟各国における実効化へ向けた各国政府の取り組みが進んでいるが、メキシコおよびグアテマラの政府の労組活動への規制が継続し、労働人権の侵害が解消・緩和されていないことも明らかになった。2022年度はGVCをめぐる国際的な人権レジームがラテンアメリカ諸国に浸透し、実効性を持ちうるために不可欠な要因となる、労働行政の制度変化の分析に取り組んだ。これにより、中央政府の指導の下で労働行政の法治徹底を進めるチリ、労働行政を対米貿易に即して制度再構築したドミニカ共和国において労使紛争の低減が見られ、労働行政を地方行政に依存するメキシコおよび労働行政に慢性的な予算不足を抱えるグアテマラにおいて労使紛争が低減されないことが明らかになった。以上の成果には次のような意義がある。第一に、国際レベルで推進される人権保護規範ないし条約が各国で実効性を持つためには国内の労働行政の制度変化が不可欠である。第二に、国内の労働行政を国際人権規範に即して制度再構築するためには中央政府のイニシアティブが不可欠である可能性が高まったといえる。
