项目摘要

本研究は、インドにおいて、とくに2000年代以降重要な社会問題となった土地収用問題を多角的かつ歴史的なパースペクティブから検討することを目的としている。初年度の2019年度は、2013年制定の土地収用法の特徴を考察し、争点となっているいくつかの具体例について、各種資料を収集した。2020年度および2021年度には、新型コロナ問題により予定していた現地調査が叶わなかったために、初年度に収集した文献調査と判例分析を敷衍する形で研究を進めた。また、土地収用制度と密接に関連する土地登記制度のインドにおける改革状況についての調査と、インド土地収用制度の起源である19世紀における制度の改革の調査に取り組んだ。これらの進捗を背景に、2022年度には、一つには、インドにおける土地登記制度の改革状況についての論文をまとめ、発表した。論文では、暫定的な土地権原制度から確定的な土地権原制度へというインドの改革がどのような経緯で行われており、その進捗状況を確認しつつ、インドに適した改革がどのようなものであるかの議論を整理した。また、第二に、19世紀初頭から19世紀末における英領インドにおける土地収用制度の展開の歴史を議会資料などを集めて検討し、また鉄道の敷設との関係なども調査した。そうした調査で得た知見を、研究会などで発表し、インドや中国の近世における土地制度の展開を専門とする研究者と意見交換を行った。それらの研究蓄積をもとに、論文の草稿を仕上げた。

This study aims to address important social issues and land use issues in the 2000s. The characteristics of land acquisition and use formulated in the first year of 2019 and 2013 were investigated, and various data were collected. In 2020 and 2021, we will conduct in-situ research on new problems, literature collection and case analysis in the initial year. The research on the reform status of land registration system, the origin of land acquisition system and the research on the reform of land registration system in the 19th century are divided into three groups. In 2022, the reform status of the land registration system was discussed. This paper discusses the reform of the provisional land use system, the establishment of the land use system, the confirmation of the progress of the reform, and the reorganization of the discussion. From the beginning of the 19th century to the end of the 19th century, the history of the development of the land acquisition system in the United Kingdom, the collection of parliamentary data, the investigation of the relationship between the laying of railways and the construction of railways, etc. The survey was conducted to obtain knowledge and opinions, and the research meeting was held to discuss the development of land system in modern China.
