项目摘要

2022年度は、協働的参加について、我が国における「地域」(条例に規定されている「地域」自治的団体）を素材として、整理検討した。近時、「地域」の協働的参加が注目を集めており、自治体の協働的参加論と比較検討する素材として有益であると考えた。具体的には、「地域」を客体・客体主体中間体・主体として区分し、それぞれについての法的位置づけや機能を整理しつつ、既存の行政法理論から解明をおこなった（例えば、自治体等による「認証」といった「地域」に特徴的な仕組みを検討した）。この成果は、熊本大学法学部付属「地域の法と公共政策教育センター」における「第３回実践社会科学研究会（2023年4月10日開催）」で報告がなされ、2023年度に論文にて成果が公表される予定である。今後の課題としては、規制・政策客体からはじまり、参加論から、公私協働論、連携・ネットワーク論を経て狭域自治主体論にいたる中で、「地域」が有するこれらの側面を一つ一つ精緻に分析する一方で、様々な側面に通底する一貫した「地域」概念の構築可能性を探ることである。以上のような「地域」の協働的参加の研究によって、2021年度に検討した個人の協働的参加とともに、自治体の協働的参加論の位置づけを明らかにする比較材料が豊富となった。派生的な研究成果としては、中嶋直木「地方議会議員の懲罰と司法審査」斎藤誠＝山本隆司編『行政判例百選Ⅱ〔第8版〕』（有斐閣、2022年）292-293頁があげられる。直接、自治体の参加や出訴に係わる事案ではないが、この判決では、「権限」的側面を有する地方議会の議員活動が「権利」として把握されており、このことは、同じく「権限」的側面を有する自治体の「自治権」やそれに基づく「参加権」の基礎理論的解明に、有益な示唆を提供する。
