项目摘要

本研究課題は、本年度において「「フランス型」議院内閣制の生成と展開ー第三・第四共和制における憲法実践からー」『朝日法学論集』第54号（2022年9月）という実績を得た。前年度までの「歴史的研究」は、概ね、大革命以来のフランスの個々の政体－個々の歴史的段階を単独で取り出し、そこでの大臣責任制の特質を集中的に検討する、という手法を取っていた。それに対して、本年度の、この研究実績は、フランス憲政史における二つの異なる歴史的段階における大臣責任制と議会政治の動態を、相互に比較する手法を採用し、研究実績を上げるに至った点で新規性がある。一国の憲政史における二つの異なる歴的段階の比較、すなわち「垂直比較」の比較法的アプローチは、今回、フランス第三共和政（1875～1940）と、フランス第四共和政（1946～1958）を垂直に比較する形で行われた。一次資料を詳細に比較検討し、且つ、同時代以降に自律的なディシプリンとして成立したフランス公法学の二次資料も批判的に検討することで、本研究は、同時代において成立したとされる「フランス型」議院内閣制という「一つの範型」が、実際には、当事者にとっては、弾劾制度など、他の政治制度と「比較可能な一つのオルタナティブ」に過ぎないことを論証した。比較憲法学上の議院内閣制論における通説的見取り図を相対化しうる知見に至ったと言える。一般に、この二つの体制において、フランスは自身が「共和政体」の国家であるというアイデンティティを確固としたとされている。大臣責任制は政治体制という外枠にとって重要な構成要素であり、共和政体の運航にとって極めて重要な規定因子である。それ故、本年度における研究の主題は、比較憲法学上にとってはもとより、フランス政治史などの分野においても重要な意義を有するものであり、本研究で得られた知見についても、同様に性格づけられよう。
