後期スコラ学派の原状回復の解体プロセスを眺めることで、近世の合意を主体とする私法理論の構築契機を明らかにするという本研究の目的に照らし、債務の発生原因にかかる分類の出発点を確定すべく、後期スコラ学派から近世自然法論にかけての債務発生原因の変遷に焦点を当てて研究を進める必要性があることを研究計画書において示した。それは、後期スコラ学派が契約、不法行為、不当利得を原因として発生するあらゆる債務を原状回復（restitutio）概念を用いて説明するのに対して、後期スコラ学派と近世自然法論の仲介者と評されるレッシウスの法理論を経て、グロチウスやプーフェンドルフといった近世自然法論者になると債務の発生原因を合意とその他（不当利得・不法行為）に大別するようになるという点について、その変遷の要因にかかる考察が不足しているからである。こうした観点から、上記の変遷を明らかにすべく、後期スコラ学派の影響を受けていると評されるグロチウスの『オランダ法学入門』（1631年）において展開される私法理論やその基礎にある権利およびその発生原因を把握するために、文献を収集するとともに、それらを分析・検討するなどの研究を進めてきた。具体的には、原状回復の解体プロセスに着目しつつ、後期スコラ学派の原状回復を中心とした私法理論との比較をとおしてグロチウスの私法理論の特徴を明らかにした。しかし他方で、当初2022年度に予定していた研究テーマについては最終年度に繰り越すこととなった。また、COVID-19の世界的大流行の影響が依然として続いていたことにより、当初予定した海外での関連資料の収集が実現できなかったことも研究実績に大きく影響を与えている。
