本研究は、法制度の変更がなされる場合、従前の法制度への信頼はいかなる場合にどの程度保護されるのかという問いに憲法の観点から取り組み、信頼保護原則に関する検討を行うものである。特に、ドイツにおいて議論が盛んに行われている憲法上の信頼保護原則の保障内容と機能、限界を検討することを課題としている。本年度は、昨年度に引き続き、日本及びドイツの再生可能エネルギー法改正に関する書籍や雑誌及び、信頼保護原則及びその基礎付けとなる法治国家原理、基本権保障に関する書籍や雑誌を蒐集し、分析、検討を進めてきた。特に、一般的な信頼保護原則と財産権や職業の自由との個別の基本権保障との関係が示されているドイツ連邦憲法裁判所の決定（2020年6月30日）を中心に見てきた。また、研究最終年度の予定であったため、研究の総括に向けて、既に2019（令和元）年度に遂行した、租税法分野におけるドイツ連邦憲法裁判所判例及び学説の検討によって得られた、違憲審査の際に比例原則と共に用いられる信頼保護原則の位置付けや具体的な衡量審査の在り様についての分析結果を、新たに出された文献や判例を取り入れつつ、とりまとめる作業を進めてきた。加えて、政策的な判断によって創設された権利に対する憲法上の財産権の保護の及び方、すなわち、事後の政策の変更によって当該権利の内容が縮減されたり、廃止されたりした場合に、憲法上の保護がどのように及ぶのかという点に関連して、知的財産法制の問題を取り上げ、論文を作成した（研究成果1.）。

To improve the judgment of the policy, to create a legal system for property protection in the Constitution, to improve the policy afterwards, to reduce the content of the legal system, to improve the legal system for property protection in the Constitution and to improve the legal system for property protection (Research Results 1.)
