本研究では、刑法における「危険」の概念に関して、現在特に問題となっている犯罪現象・犯罪類型を取り上げ、個別の犯罪類型における「危険」の意義・内容および判断基準を個別要件の解釈論として、各論的に展開し、明確化することを目的として設定した。当初の研究計画では、最終年度となる予定であった2022年度においては、これまでの研究成果をまとめ、論文として公表することを目標としたが、一部を除き未だ完成に至っておらず、2023年度まで補助事業期間の延長の承認を受け、引き続き公表を目指している途上である。2022年度の具体的な研究内容としては、まず、私文書偽造罪について、「私文書偽造の本質」松原芳博編『続・刑法の判例（各論）』（成文堂）では、全ての虚偽文書の作成ではなく、いわゆる「有形偽造」に処罰が限定されている根拠を、文書の受領者が文書の内容を信頼し、行動に移すときの心理状態に着目し、文書の作成者の特定が文書の信頼の基礎となっている構造を分析し、その構造から文書制度に対する危険をもたらす有形偽造において考慮されるべき作成者の属性を明らかにした。次に、遺棄罪に関して、現在の判例・学説の議論状況の整理と、旧刑法から現行刑法初期の判例・学説の形成に関して、当時のドイツおよびフランス法の議論を参照しつつ、沿革的調査を行った。2023年度の公表に向けて、現在の議論に関する部分と沿革部分を分けて論文執筆中である。また、未遂犯について、総論的な基準ではなく、個別の犯罪ごとの実行の着手時期の実務上の運用に着目し、放火罪を中心に、裁判例を調査した。
