项目摘要

本研究は、「災害弔慰金の支給等に関する法律」（昭和48年9 月18日法律第82号）に基づいて支給される災害弔慰金のなかで、その支給対象となっている災害関連死（すなわち、災害にともなう過労や環境悪化等による病死などの内科的死因にもとづく死亡）を取り上げて、各地方自治体で行われている災害関連死の認定の基準や手続をめぐる実態をできるだけ明らかにすることを目的とした。このために、当初、本研究の手法は、全国的なアンケート調査・集計および聞き取り調査に依拠して分析・考察を行うことを中心としており、かつ、アンケートおよび聞き取り調査は時期的に近接して行いたいと考えていたので、コロナ禍の影響が落ち着くまで調査の実施は延期することとした。他方、東日本大震災10年を迎えた一昨年度は、政府も「災害関連死」の事例収集を行うということであったので、新たな研究計画として、これまでに公表されてきた災害関連死の認定基準および災害関連死をめぐる裁判例の考察をすることを計画し、その成果として「災害関連死について」（アルテス　リベラリウス第107号）を公表した。令和3年度もコロナ禍の影響で調査を行うことは困難であったため、一昨年度に公表した上記の「災害関連死について」をもとに、その後の関連資料も収集して新たな分析を行った結果、本研究の目的であった統一的な認定基準および手続の実態とは別に、異なる観点から災害関連死を認定している自治体があることが見えてきた。令和4年度もコロナ禍の影響により、研究期間を1年延期した。令和5年度においては、新たに見えてきた視点をもとに従来とは異なる観点から災害関連死を認定していると思われる自治体に絞って聞き取り調査を実施し、これまでの考察と合わせて実証し、その成果を主に実務に携わる方々を対象として分かり易く参照できる資料の作成・交付を行うことで、本研究の総括をしたいと考えている。
