项目摘要

２０２２年度は、主として、ドイツ連邦弁護士法43条ａが定める5つの弁護士の基本的義務の一つである「事に即して振る舞うべし(Sachlichkeitsgebot)」と取り組んだ。この"Sachlichkeisgebot"が意味するところに内包・外延とも当てはまる日本語の表現は、研究者の知る限りなさそうであるが、要は「筋道をはずさないこと」といってよさそうである。このドイツ特有とされる弁護士の義務の歴史はかなり遡る。この義務が如何に重視されていたかは、古い時代におけるこの義務違反に対する処罰からうかがえる。公開の場に弁護士を引出し、この義務に違反する弁護士書面を破り、その足下に投げつけてその面目を潰したのであった。現在では、その内容は条文が示す様に「真実義務」と「侮辱的言動の禁止」に集約されている。法治国家原則のもと紛争解決機構の独立の一機関と位置付けられる弁護士が負う真実義務は、依頼者の利益擁護をもその責務と時に相克する。このジレンマに呻吟する弁護士の姿を書き出すことができた。後者の禁止は、裁判所ないしは相手方（弁護士）批判の限界である。ドイツの弁護士は時として過激な表現を用いて批判をする。表現の自由の下、権利の擁護者として「批判」をその職業上の信条とする弁護士につき、連邦憲法裁判所はどこにその限界線を引いているかを具体例を用いて示した。もう一つには、ドイツ語での寄稿の機会をえて、独日の位相の違いを踏まえ、わが国の弁護士法制の展開と弁護士の利益相反の禁止に関する規律および禁止違反の訴訟行為の効果に関する最上級裁判所の判例の展開を追った。日独いずれも、弁護士職業法は法律（弁護士法）と弁護士の自律的規律（職務基本規程）の2階建てとなっているが、その両者の関係についての理解は、彼我で異なっている。利益相反についてのわが国の規律とわが国の裁判例を紹介しつつ、その問題点を指摘した。
