项目摘要

本研究では、アメリカにおける合衆国有地および部族保有地から発掘または発見された先住民族の遺骨・副葬品の取扱に係る法制度（NAGPRA等）およびその運用実態を理解し、今後日本でも整備が急がれているアイヌ民族の精神文化に配慮した埋蔵文化財の管理体制構築の示唆を得ることを目的としている。主な研究方法は、①アメリカの埋蔵文化財の取扱およびアメリカ先住民族の文化遺産保護に関する現行法を理解するための文献資料調査、②発掘調査や建設工事等によって発掘・発見されたアメリカ先住民族の遺骨・副葬品の管理や返還に携わった経験を持つ関係者に対するヒアリングである。今年度は、(1)これまでの研究成果をまとめた論考の公表、(2)ハワイ州におけるNAGPRA運用に係る法制度やハワイ先住民の遺骨等返還の事例に関する文献資料収集、(3)NAGPRA運用に係るフォローアップのための現地調査を予定していた。(1)まず第９回世界考古学会議にてアメリカのNAGPRAを踏まえた上で日本のアイヌ民族のご遺骨返還の現状と課題についての考察を口頭発表した。つづいて、2022年12月に信山社出版より刊行された『先住民族と法』（小坂田裕子他編）に、アメリカのNAGPRA制度についての調査成果をまとめた論考を寄稿した。(2)NAGPRAに関連するハワイ州の法制度の整理およびハワイ先住民の遺骨等返還事例に関する文献・資料調査を行った。その結果、連邦政府から部族認定を受けていないハワイ先住民の遺骨等返還における課題および返還を円滑に行うための州政府独自の取組を明らかにした。(3)引き続き現地調査が難しい状況であったため、現地調査は延期したが、オンラインを通じてNAGPRAに詳しい専門家と意見交換を行い、とくに発掘・発見された先住民族の遺骨・副葬品の返還において、アメリカ陸軍工兵隊が果たす役割に特徴があることが明らかになった。

This study aims to explore the legal system for the acquisition of the remains and burial objects of the ancestors (Nagpra, etc.) and to understand the state of its application in order to provide an urgent basis for the establishment of a management system for the spiritual and cultural resources of the peoples of Japan in the future. The main research methods include: (1) literature data survey on the understanding of existing laws related to the acquisition and protection of cultural heritage of indigenous peoples;(2) development and investigation of construction works; and (3) management and return of cultural heritage of indigenous peoples. This year,(1) the results of this research are discussed and reviewed,(2) the collection of literature and data related to the legal system for the application of NAGPRA in the state, and the cases of the return of the remains of the ancestors, etc.,(3) the field investigation of the application of NAGPRA is determined. (1)The 9th World Archaeological Conference on the Status of the Return of the Bones of Japanese Ethnic Groups In December 2022, Xinshan News published the article titled "The Law of the First Nation"(edited by Yuko Kosakata), and the results of the investigation into the Nagpra system were submitted. (2)NAGPRA related to the reorganization of the state legal system and the investigation of documents and data related to the return of the remains of the ancestors.
