本研究は、アメリカ合衆国の諸法域（連邦・州）の証拠開示等の法制の比較を通じて、①証拠開示の遺漏なき実効的な実施のための方策や運用、及び、②検察官による証拠開示と当事者主義の関係の理解等に関して示唆を得ようとするものである。本年度は、昨年度、日本刑法学会第99回大会ワークショップで行った報告をベースとして「合衆国におけるBrady法理に基づく証拠開示の実効性確保に関わる近年の動向」と題する論考を法学新法に寄稿した。合衆国では、検察官の憲法上の証拠開示義務を担保する方策として様々なアプローチが用いられている。本稿では、公判担当検察官の免責を避けるため上席の検察官や所属する検察組織を相手方として民事責任を追及する試みがあることや、それらに対する合衆国最高裁の諸判断を紹介・分析したり、検察官の手持ち証拠の原則的開示を義務づけている一部の州の立法の内容や懸念点などを検討したほか、連邦法域において2020年に成立したデュー・プロセス保護法の内容や趣旨、現在の運用状況について解説をしている。また長らく新型コロナ・ウイルス感染症の拡大により海外での調査ができなかったが、2023年3月にアメリカハワイ州を訪れる機会を得たため、ハワイ・ディスリクトの連邦判事にデュー・プロセス保護法の同ディストリクトでの運用とその実務上の意義についてインタビューを実施した。実務に携わる裁判官の立場から、立法から2年を経ての同法の評価を聴くことができ、同法の運用状況をフォローアップする調査をすることができた。
