项目摘要

本年度は、当初の計画通り人権デューディリジェンスに関わる従来のソフトロー規範および自治的な取組みについての研究を進めると同時に、海外研究者へのインタビュー調査を断念したために、2-3年目に計画していた外国法の調査研究を一部前倒しして実施した。具体的な研究成果としては、ドイツの人権デューディリジェンス立法（「サプライチェーンにおける人権侵害防止のための企業のデューディリジェンス義務に関する法律（Gesetz ueber die unternehmerischen Sorgfaltspflichten zur Vermeidung von Menschenrechtsverletzung in Lieferketten: LkSG）」）について、その前提条件および正当化根拠を検討した論文を公表することができた。また、未だ公表には至っていないものの、人権デューディリジェンス立法の動向を国際貿易・投資と労働法との関係一般の文脈に位置付けた論文も脱稿済みである。加えて、個々の人権についての研究も進めており、具体的には、特定の裁判例を素材にして「性差別」概念をめぐる検討を行い、これも研究成果として公表している。
