项目摘要

今年度は、主に後述1～3の観点から研究を進め、1および2については具体的な研究成果を公表した。1.　まず、EU労働法に関わる最新の政策動向、すなわち、いわゆる欧州社会権基軸（European pillar of social rights）をめぐる動向についての研究である。これは、一般に欧州連合（EU）の社会的側面を強化しようとする包括的な政策であり、今後の動向を注視する必要があるが、労働者の国際的な自由移動保障にも影響を及ぼす可能性がある。今年度は、かかる政策動向の背景、概要およびアプローチの特徴を確認したうえで、その意義と限界を明らかにした。2.　次に、自由貿易・投資保護協定と国内労働法との関係についての研究である。本研究において、労働者の国際移動の自由に着目した背景には、国際的な市場統合が低廉労働力を利用した競争を招き、ひいては各国労働法制との間に緊張関係を生ずる可能性があるところ、当該緊張関係の調整原理として、労働者の自由移動が機能しうるのではないか、という仮説がある。しかし、かかる知見および仮説は、いずれもEU経済統合と労働法との関係をめぐる研究から得られたものであって、わが国にとってどの程度参考となるか、換言すれば、普遍性が明らかでない。そこでまずは、海外の文献をもとに、一般的な自由貿易・投資保護協定が国内労働法制との間に緊張関係を生じうるか、生じうるとしてEU経済統合のそれとどのように異なるかを研究した。3.　最後に、EUにおける越境的労働者配置（posting of workers）をめぐる新たな立法動向についての研究である。越境的労働者配置は、低廉労働力の利用が批判される典型例であるが、現在、新たな規制について立法提案がなされている。ドイツの学者にヒアリングを行うとともに、文献を収集し、その概要と意義を確認した。

This year, the main points of 1~3 are discussed, and the specific research results are presented publicly. 1. The latest policy trends, European pillar of social rights and research on EU law The European Union (EU) is a society in general, including the strengthening of policies, the need for future developments, and the possibility of international freedom of movement protection. This year, the background, summary and characteristics of the policy trends are confirmed, and the significance and boundaries are clearly defined. 2. Second, free trade, investment protection agreements and domestic law, the relationship between research and development This study focuses on the possibility of tension between the international market integration and the competition between countries, and the adjustment principle of the tension between the international market integration and the competition between countries. The relationship between EU economic integration and law is studied in detail. The degree of reference for EU economic integration and law is discussed in detail. A study on the tension between the domestic legal system and the general free trade and investment protection agreements, as well as on the integration of the EU and the international literature. 3. Finally, the EU is concerned about the posting of workers across borders. Typical examples of cross-border labor allocation and utilization of low-cost labor force include new regulations and legislative proposals. The author of this article is interested in the collection of literature and the significance of the book.
