国境を越えた経済活動が盛んになるなか、ビジネス分野における人権侵害をいかに防止するかという問題が注目されている。本研究の目的は、この「ビジネスと人権」の問題について、集団的労働法規制が果たすべき役割に関する理論的基礎を明らかにすることにある。具体的には、労働問題のステークホルダーとして想定されてきたのはいかなる存在かを明らかにし、それらが問題解決のためにどのような役割を果たすかを検討することにある。研究実施初年度においては、文献研究を通じて、日本およびアメリカにおける現状の基礎調査を実施した。その結果、次の２つの成果を得た。第１に、「ビジネスと人権」において主導的役割を果たすことが想定される労働組合に焦点を当て、現代のアメリカにおいて占める地位を明らかにした（藤木貴史「アメリカにおける団体交渉法制の困難と労働協約締結への課題：米Amazon社における労働組合の組織化から」季刊労働法279号（2022年）78-94頁）。具体的には、人権侵害を監視するための重要なメカニズムと考えられる団体交渉について検討し、アメリカ法における団体交渉が労働協約依存的であるのに対し、日本における団体交渉は、労使間のコミュニケーションの正常化というアメリカにない視点をもつことを明らかにした。この点は、「ビジネスと人権」を考えるうえで日本における集団的労働法規制が有利に働きうることを示唆するものといえる。第2に、労働分野において保護されるべき「人権」としてどのようなものが考えられるか、アメリカ法を題材として検討した（藤木貴史「アメリカ労働法における人権・基本権の役割――経済的民主主義に向けて」浜村彰先生古希『社会法をとりまく環境の変化と課題』（旬報社、2023年）87－110頁）。市民的公共性を追求するという視座を基本権保障の趣旨に読み込めるか否かが、人権の範囲を左右する可能性が示唆された。
