2022年度は、日米の裁判官選定罷免手続について、主だった研究を参照し、それをまとめたレビュー論文（川鍋健「裁判官の選定罷免について：司法の民主的責任に関する日米比較・序説」、早稲田政治経済学雑誌398号（2022年）、19頁以下（査読あり）を発表した。そこでは、まず、日本においては裁判官選定罷免について、実践的にも理論的にも選挙など民主的な手段で行うことに対するネガティヴな理解を看取することができた、ということをあきらかにした。他方、アメリカでは、いかなる公職であっても民主的正当性に基礎付けられるべきであり、裁判官も例外ではない、という理解を明らかにした。1970年代のいわゆる司法の危機の際に裁判官選定手続に関する研究は盛んに行われた後、研究は低調であったが、現代にあっても当時問題とされた状況は依然残っていることを明らかにした、という意義、重要性を本研究は示した。また、この研究を通じて得られた知見を基礎に、本研究の成果として2本の研究報告を行なった。川鍋健「裁判官を選ぶ権利」、第1回アメリカ憲法の理論と実践に関する研究会、2022年9月、福井県立大学では、アメリカの裁判官選定罷免手続の背後にある理念としての裁判官を選ぶ権利について論究した。川鍋健「裁判官の民主的正当性」、政治経済学会、2023年3月、早稲田大学では、論文で明らかにした民主的な裁判官選定罷免手続へのネガティヴな評価の一方で、日本の国会が裁判官選定罷免手続に重要かつ多岐にわたる関与を行なっているのではないか、という指摘を行った。最後に、本研究の直接的な研究成果ではないが、本研究の一連の成果についての報告を依頼され、報告を行なった。川鍋健「裁判官の選定罷免について：司法の民主的責任に関する日米比較・序説－公刊業績に関する検討として」、東京法哲学研究会、2023年3月、オンライン。

2022 Annual Report on the Selection and Removal of Magistrates: A Comparative Study of the Responsibilities of Judicial Democracy, by Ken Kawabe, Waseda Journal of Political Science, No. 398 (2022), pp. 19 and below. The judge chose to dismiss him. The judge chose to remove him. The other side, the public office, the legitimacy of democracy, the magistrate, the exception, the understanding. In the 1970s, when research on the selection of judges was in full swing during the judicial crisis, research was low-key, but in modern times, the problems and conditions at that time are still incomplete. This research clearly demonstrates the significance and importance of this research. The results of this study are based on the knowledge gained from this study.
