项目摘要

本研究の目的は、人権条約機関および各国の各種国家機関による実践の包括的分析と、主要国の憲法学における権力分立に関する先行研究の検討を通じて、人権条約機関と個別の国家機関との間の「国を超えた権力分立」が、いかなる原理・原則によって規律される（べきか）、また、それが、「国家」を単位としてきた従来の国際法学にいかなる理論的示唆を与えるか、を論ずることである。この目的のもと、2022年度は、主に次の3つの作業を行った。（１）国を超えた権力分立を論ずるにあたっては、敬譲（deference）が重要な概念となる。そこで、国際裁判所による国内的決定への敬譲を主題とする3つの最新のモノグラフ（Fahner (2020)、Dothan (2020)、Shirlow (2021)）を比較検討し、国を超えた権力分立の成立可能性やその課題についての示唆を得た。この成果の一部を、京都大学国際法研究会において報告し、その後、書評論文として国際法外交雑誌において公表した。（２）人権条約機関が、国内人権機関やNGO等の、非伝統的なアクターとどのようにかかわるのかについて調査し、国を超えた権力分立において、そうしたアクターがどのように位置づけられ得るかについて考察した。この成果の一部を、京都大学国際法研究会において報告し、その後、Max Planck Encyclopedias of International Lawへの査読済記事（共著）として公表した。（３）人権条約機関と個別の国家機関（議会、裁判所、各種行政機関）との間でどのように権限配分を行うべきかという問題への、国内憲法理論の応用可能性について検討した。これにより得られた知見の一部を、「憲法および人権条約を接合する多元的・非階層的・循環的人権システム理論の可能性」研究会で報告した。
