项目摘要

本年度は、次の2つの作業を行った。第1に、国家機関間規範の体系的理解への第一歩として、グローバル国内人権機関連盟（GANHRI）の実践の分析を通じて、国内人権機関に関するパリ原則がどのように解釈適用されているかの検討を行った。その結果、GANHRIによるパリ原則の解釈適用には、①ダイナミックな解釈の原則、②規範的グラデーションの原則、そして③総合的評価の原則、の3つの原則が用いられていることを明らかにし、そうした原則が、国家間の規範としての国際法とは異なり、国家機関間のインフォーマルな規範であるというパリ原則の固有の性質に由来するものであることを示した。この研究成果に基づいて、アジア国際法学会日本協会第12回研究大会において研究報告を行い（Best Paper Award受賞）、また、その報告で得られたフィードバックを踏まえて執筆した論文は国際査読誌であるNordic Journal of Human Rightsへの掲載が決定している。第2に、国内議会間の規範の生成過程や内容、その履行確保の方法、そしてそうした規範が国際人権条約の実現において果たしている役割について研究した。その際には、日本やその他諸外国の議会が、どの程度・どのように、国内議会間の規範に整合的な実行を行っているかについても調査した。その研究成果の一部は、国際査読誌Human Rights Law Reviewに掲載され、また、雑誌『法律時報』にも特集「グローバル法VS国際法――国内における実現の場面から」を構成する論文として掲載された。2022年4月より常勤の大学教員職に就くことになったため、2022年3月末で学振特別研究員PDを辞退した。これにより、本研究課題は1年で終了することとなるが、その研究内容については別の研究課題に統合する形で継続して行きたいと思っている。

This year, the second and third operations were carried out. The first step is to analyze the implementation of GANHRI, and to discuss the application of GANHRI principles to the understanding of the system of norms among state organs. In addition, the Ministry of Foreign Affairs and the Ministry of Foreign Affairs of the People's Republic of China conducted a survey on the implementation of the regulations between the two parliaments. A part of the research results was published in the International Journal Human Rights Law Review and published in the Journal Legal Times. The paper was composed of a special collection of articles entitled "International Law VS International Law-- In April 2022, Chang Qin's position as a university teacher was dismissed. At the end of March 2022, PD, a special researcher of Xuezhen, was dismissed. This research project is completed in one year, and the research content is integrated into the research project.
