本研究は、フランス・パリ控訴院およびパリ商事裁判所に設立された国際商事部について、その設立の背景や運用の実態を調査し、日本における英語や英米法に対応した国際商事部の設立の実現可能性を探求することを目的とする。２０２２年度は、当初はフランス等外国に赴いて、関係する実務家や研究者にインタビューを実施するなどの調査を行う予定であった。しかし、新型コロナウイルス感染症に関する懸念がまだ完全に払拭できたとは言い難い状況であったので、海外への渡航が必要となる調査活動は見送らざるを得なかった。その代わり、文献の収集・読解による調査・研究を進めることにした。フランスの裁判所制度・民事訴訟手続に加え、また、フランスの国際商事部が英米法の特徴を意識した手続を可能としていることから、英米法圏の手続法や国際取引紛争解決制度に関する文献も収集し、読み進めた。他方で、日本法の視点からの研究の必要も感じ、関連する文献の収集・読解に努めた。パンデミックの影響もあって、国内手続にせよ、国際的な裁判・仲裁・調停にせよ、オンラインへの対応は不可欠である。その点で、昨年の民事訴訟IT化法は、本研究の遂行のためにも重要な考察対象である。さらには、仲裁法の改正の論議が進み（※２０２３年４月末に、シンガポール調停条約の実施に関する法律等とともに成立、公布された）、そこでは、東京・大阪地方裁判所での競合管轄や一定の場合に日本語訳の添付が不要となるなど、国際取引紛争の解決における日本の裁判所の役割の変化が見られる。本年度は、海外調査ができなかった代わりに、様々な視点から国際取引紛争における裁判所の役割のあり方について、文献を通して知見を深めた。

In addition, the discussion on the revision of the Arbitration Law has been advanced (※ By the end of April 2023, the establishment and publication of laws and regulations related to the implementation of mediation treaties), and the competition jurisdiction of Tokyo and Osaka District Courts has been increased in certain cases, and the division of Japanese courts has been observed in the settlement of international disputes. This year, overseas investigations have been carried out, and international disputes have been cited.
