2022年度は、研究の基盤を固めるために、国内外の文献調査と海外調査の準備作業を進めることを予定していた。また、ドイツの未決拘禁執行について妥当する憲法上および国際法上の基準を明らかにするために、基本法、欧州人権条約、欧州評議会その他の基準がそれぞれどのようなものであり、いかなる影響を与えているのかについて調査を行う必要があった。その成果の一つとして、2020年に改訂された欧州刑事施設規則の翻訳資料を公表した。欧州刑事施設規則は、欧州評議会が策定した基準であり、欧州人権裁判所や欧州拷問等防止委員会（CPT）にも大きな影響を与えている。欧州刑事施設規則は、未決拘禁についても適用され、「未決被拘禁者」に関する独立した章も設けられている。改訂前の規則からどのように変わったのかも含め、同規則は国際社会の新たな基準を知るにふさわしい素材である。ドイツの未決拘禁を知る資料に関しては、1960～70年代に開催された行刑委員会の議事録を収集した。この歴史的資料の分析によって、行刑と未決拘禁との関係性についても明らかにすることができると思料される。また、本研究では、少年の未決拘禁についても検討の対象としている。2022年4月1日に施行された改正少年法は、18歳および19歳の少年を「特定少年」と位置づけ、成人と同様に刑事裁判において審理する「原則逆送」事件の範囲を拡大した。これにより、家庭裁判所による検察官送致後に、身柄拘束を受ける少年が増加することが予想されている。特定少年が関わる事件について聞き取り調査を行う中で、警察留置場に留置される少年の状況の一端を知ることができた。この状況の問題性について理論的検討を進めることが今後の課題である。
