项目摘要

2022年度は、（A）第三国定住レジームとセクシュアリティの規範の関連性と、（B）国境における庇護希望者と「LGBTIQ+難民」の保護の関連性について研究を進めた。（A）に関しては、冷戦期から現在までのアメリカにおける庇護政策と第三国定住政策に関する資料・データを収集、分析し、特に2017年以降の難民保護のポリティクスにおける現代的な特徴をとらえることを試みた。9月には、ニューヨーク州ニューヨー市とカリフォルニア州オークランド市を訪れ、性的マイノリティ移民の支援団体、庇護希望者支援団体、各州の第三国定住コーディネーター、第三国定住難民受け入れ団体、国連移住機関（IOM）等の訪問・聞き取りや、NY市立図書館、GLBT歴史社会資料館、エリス島移民博物館、エンジェル島移民博物館での資料収集を行なった。また、カリフォルニア大学バークリー校の難民法学研究者らとの意見交換を実施した。（B）に関しては、トランプ政権下の移民政策に焦点を当て、国境での庇護希望者の制限政策とCOVID-19対策としての国境政策についての資料を分析し、性的マイノリティの庇護申請へのアクセスと公衆衛生を軸とした排除の歴史と接続する議論を展開した。また、日本国内における性的マイノリティの難民認定について、不認定処分の取り消し（大阪地方裁判所）が命じられるなどの新たな展開が生じたため、関連資料の収集や支援団体への聞き取りを実施した。

In 2022,(A) the normative relevance of third-country settlements, and (B) the research on the protection relevance of asylum seekers and LGBTIQ+ refugees at the national level were conducted. (B) The focus of immigration policy under international law, the restriction policy of asylum seekers in the country, the COVID-19 policy, and the analysis of data in the international policy, the discussion of the history of asylum application, the public health axis, and the exclusion of asylum seekers. In Japan, there is a problem of refugee identification and non-identification (Osaka District Court), and a problem of related data collection and support for refugee identification and non-identification (Osaka District Court).
