鎌倉幕府の権力構造の根幹である守護・地頭制度の成立過程について、本研究では、第一に、当該制度に関する幕府と朝廷の交渉内容、第二に、この交渉の前提となる源平の内乱期における武士の行動の特質、第三に、地頭設置が正当な行為として受容されるに至った背景、の三点を具体的な検討課題とした。まず、第二の課題については、内乱が全国的に展開するなかで、源頼朝勢力による源義仲余党や平家方の武士の所領の没収と給付が広範に行われていることに注目した。また、第三の課題に関して、中世社会においては、刑事犯人の財産は検断権の行使者がこれを没収しうるという慣習が存在し、それゆえ朝廷が謀叛人と認定しその追討を頼朝に命じた国家的反逆者の所領を頼朝勢力が没収することは正当な行為であったことを確認した。しかしながら、重層的な土地所有を特質とする荘園公領体制下においては、上記の頼朝勢力の行動は、荘園領主の権限(とくに壮官の任免権)を侵害するものであったから、謀叛人所領の没収・給付問題は、荘園領主層を主たる構成要素とする朝廷と平家追討戦を遂行する武士を統括する鎌倉幕府の間の政治的な争点の一つとなった。以上の理解を前提に、第一の課題に関して以下の成果を得た。当初幕府は朝廷に大幅に譲歩していたが、源義経の要求に屈して頼朝追討宣旨を発給した朝廷の態度に激怒した頼朝は、1185年末、義経追討を目的とした惣追捕使の設置とともに、それまで譲歩してきた謀叛人所領の全面的な没収と当該地への地頭設置を朝廷に認めさせた。しかし、それ以後も地頭の設置やその権限をめぐって各地で紛争が頻発したため、頼朝は一転して譲歩の姿勢をみせ、両者の間に和解が成立、さらに地頭の権限を謀叛人である前司の有していた権限に限定した1186年10月の太政官符により、地頭制度は荘園公領体制下において安定的な位置を占めるに至ったのである。
