本研究の具体的課題は、朝鮮李朝時代の紛争処理をめぐる在地慣行の中から、私和と復讐を取りあげ、その実態、在地社会における位置づけ、国家の法及び司法システムとの関係、歴史的推移等を明らかにすることにある。以下、研究実績について概要を述べる。私和や復讐に関わる史料には、『朝鮮王朝実録』『備辺司謄録』『承政院日記』など王朝編纂の基本史料、法典類、『秋官志』など判例集的なもの、詞訟録などと呼ばれる中央・地方官衙の裁判関係古記録、個人の文集・著書、個人宅に伝来する所志類など紛争・裁判関係の古文書・古記録などがある。本研究では、こうした史料の収集につとめるとともに、その中から『秋官志』・『王朝実録』・詞訟録類・所志類を中心に李朝後期18〜19世紀の私和・復讐に関わる記事を抜き出し検討した。この作業は中国明清との比較も含め、史料・時代の範囲を広げて継続中であるが、これまでに得られた知見には次のようなものがある。李朝後期の所志類等裁判記録をみていくと、この時期、民事的な事件に関わる私和は個人間のものも、親族集団・村落が主体になるものも広範にみられ、国家の側もそれを追認、奨励する傾向があった。一方で、殺人など刑事的な事件に関わる私和もときにおこなわれていたが、国家はこれについては厳禁する姿勢をとっていた。また、この時期、復讐殺人に関する史料も残されているが、その法的処理は一定せず、若干の減刑にとどめる事例から罪をとわず表彰の対象とする事例まで、様々な処置がとられていた。それはこの問題が孝烈規範と司法制度とが衝突する領域にあるからであり、そこに李朝社会の一つの特徴を読みとることができる。以上の研究成果は近く論文の形で公表する予定である。

The specific topics of this study include: dispute settlement in the Korean Dynasty, choice of private and public relations, state of affairs, position in local society, relationship between state law and judicial system, and historical transition. The following is a summary of the research results. The historical records of the private and complex relations, the records of the Joseon Dynasty, the records of the preparation department, the diaries of the Chengzhengyuan, the basic historical materials compiled by the dynasty, the legal codes, the records of the autumn officials, the ancient records of the adjudication relations of the central and local officials, the personal collections, the books of the personal residence, the ancient records of the adjudication relations, the ancient records, etc. This study focuses on the collection of historical materials in the late 18th and 19th centuries of the Li Dynasty. This work is related to the comparison between Ming and Qing Dynasties in China. In the later period of Li Dynasty, the judgment records of the people's will, the civil affairs, the personal affairs, the family groups, the village subjects, the ratification and the encouragement tendency. A party, a murder, a criminal incident, a crime, a crime. For example, in the case of a crime committed by a criminal, and the case of a crime committed by a criminal. The problem of filial piety and the judicial system are in conflict with each other. The above research results are in the shape of a paper.
