项目摘要

本研究は、「触法行為」のあった知的障害者に対して、司法と社会福祉の連携のあり方、またその構築にむけた課題を明らかにすることが目的である。実施計画に基づいて、調査項目の選定のためにプレ調査を実施した後、2つの調査協力者群に対して、それぞれ複数のインタビュー調査を行った。調査Iは、関係する司法領域の従事者4名(弁護士、保護司、保護観察官、刑務官)に対して、それぞれ個別インタビューを行った。その後、全員を対象としたグループインタビューを実施した。当初予定していた警察関係者は、先方との調整が折り合わず、調査協力者から除外した。調査Iの結果、受刑中から本人を福祉につなぐ試みが浸透してきている現状をふまえた上で、個人ではなく地域に還元できる関係機関のつながり、丸投げをしない丁寧な支援のつなぎ、本人らが社会とつながれる中間受け皿づくり、等が課題として明らかになった。調査IIは、関係する社会福祉領域の従事者4名(精神科病院のソーシャルワーカー、刑務所のソーシャルワーカー、地域生活定着支援センターの相談員、市町村のソーシャルワーカー)に対して、個別インタビューを行った。同じく、全員を対象としてグループインタビューを実施した。調査Hの結果、司法と福祉の連携によって、支援の枠組みが構築されてきた実感がある一方、福祉関係者による司法や法律への理解が足りない、失敗する自由のない選択肢の提示、生活保護や障害手帳の申請先など、誰が責任をもつのかがあいまい、等の課題が示された。両調査の結果から、お互いの顔が見えてわからないことがききあえる関係、議論の中心になりがちな出口支援だけでない入口支援の重要性、再犯防止をゴールにしない関わり等が、今回の調査研究で明らかになった課題に対する解決の糸口になると考えられた。今後は、本研究の結果をふまえて、司法と社会福祉の連携プロセスのモデル化のために、さらに分析をすすめる。
