项目摘要

「知的財産」の指導が導入された新しい学習指導要領が,平成25年度に完全実施され,中学校では技術科,高校では工業科,商業科などの専門教科をはじめ、情報関連教科・科目や芸術科で実施される。特定の教科に限定されず、複数の教科・科目と多岐にわたるため,校種間の接続や教科間の境界,あるいは知財教育と関連教育領域との境界が不明確になりがちである。特許権や著作権など各種の知財権の権利取得にあるのか,あるいは工夫や創造といった広い意味での知財の学習であるのか,いまだに明確になっていないという課題がある。さらには,児童生徒に工夫や創造する力を育てることはどのような意義があるのかを再度認識する必要がある。このような状況にあって,本研究は,知財教育の領域を明確にするためには,学校教育における各教科における知財の学習の範囲を見渡した上で,教科商業における「商品開発」「経済活動と法」「電子商取引」などの科目において,知的財産の学習指導を進める上で課題となる事項を発見し,その改善策を検討するものである。それを踏まえて本研究では,申請者が勤務校における教育実践を通して,知的財産の学習指導を実践的に検討し,その成果を公開することによって,今後どの商業高校でも実施しうる知的財産教育の構築を目指した。知財教育は、本来、創造と、その背中合わせの関係にある模倣について、児童生徒の発達段階に即した学習指導を行うことによって、模倣から創造へのゆるやかな転換を図る知財教育の考え方の導入が重要である。そのためには発明・尊重・商品開発といった知的創造サイクルを念頭においた知財教育は、日本の教育改革に向けて大きく期待されるところである。初等・中等教育における知財教育に関する研究は,全国的にも;まだ緒についたばかりであり,日本知財学会などでも,小学校や中学校,専門高校,あるいは地域での発明クラブなどで限定的に実施された教育実践の報告はあるが,高校商業教育を俯瞰する実践研究はまだ多くは見られない状況である。本研究では,商業・ビジネス教育を中心に,特質を生かした知財教育の系統化を進めどの学校にも通用する普遍的なカリキュラムの構築を行うことによって,確かな学力を築き,将来にわたって知的財産を尊重,活用,創造できる人材を育成する方向性の樹立に意義があったと考える。
